MINUTES

Tuesday, January 21, 2020
7:30 p.m. – Old Town House

Present: David Pattee, Chairman; Claire Matzke; William Hill; Stuart Green; Susan Robinson; Tina Miller; Wallace Perlman.

The Chairman called the meeting to order at 7:35 p.m.

I.  APPROVAL OF MINUTES

On the motion of W. Perlman and the second of T. Miller, the Commission voted unanimously to approve the 1/7/20 Meeting Minutes as amended: Page 3, fifth item under “Chairman’s Report”, change to: “S. Robinson and Victor DeMasi will be leading a field trip in April and are looking for access to the vernal pool that prompted the State Legislature for an upland review area regulation. D. Pattee stated that there is a vernal pool on Topstone which will be the backup. Ms. Robinson asked the Commissioners about liability insurance. Ms. Robinson confirmed the Northeast Natural History Conference is April 17-19 in Stamford.”

On the motion of W. Perlman and the second of T. Miller, the Commission voted unanimously to approve the 1/12/20 Site Walk Minutes.

II.  REGULATORY

Application #19-10, Robert and Sarah Schildt (owners), Juliano’s Pools (agent), 8 Church Hill Lane. Received 1/9/2020. Discussion and possible vote on an application to install a new in-ground pool with safety fence. Site Walk 1/12/2020.

Site Walk findings were reviewed. D. Pattee confirmed although not located on the map, the pool equipment location is away from the house.

On the motion of W. Perlman and the second of W. Hill, the Commission voted unanimously to approve Application #19-10.

Application #19-11, Paul Rutkowski (owner), Nazzaro, Inc., Gene Nazzaro (agent), 60 Diamond Hill Road. Received 1/9/2020. Discussion and possible vote on an application for pond restoration. Site Walk 1/12/2020.

Gene Nazzaro was present for the applicant. Site Walk findings were reviewed. G. Nazzaro estimated removal of approximately 500-600 yards of fill. S. Robinson questioned where the fish will go during the restoration. Mr. Nazzaro stated that the work can be done any time of the year without repercussions to the fish.

On the motion of W. Perlman and the second of T. Miller, the Commission voted unanimously to approve Application #19-11.

Application #20-01, Gary Avery and Elizabeth Xavier, 123 Sunset Hill Road. Received 1/9/2020. Discussion re: work being done in an area both within the regulated area of wetlands and within wetlands and a watercourse. Construction of a shed within the regulated area. Site Walk 1/12/2020.

Mr. Avery was present. He stated that arrangements have been made for manual removal of the accumulated brush. The drawing depicting the proposed shed was reviewed. Mr.
Avery stated that pre-form concrete pillars will be used to keep the shed 6-12” off the ground.

On the motion of T. Miller and the second of W. Hill, the Commission voted to approve Application #20-01 as presented. S. Robinson abstained.

Application #20-02, Chris and Deatra Nocito, 64 White Birch Road. To receive and discuss an application for shed placement, clearing dead trees and stumps and fill within the regulated area.

Chris and Deatra Nocito were present. Basic maps were reviewed in addition to the history leading to this application.

A Site Walk is scheduled for Fri., 1/31/20 at 3:00 p.m.

Application #20-03, Michael Morocco (owner), Nazzaro, Inc., Gene Nazzaro (agent), 65 Diamond Hill Road. To receive and discuss an application for restoration and enlargement of existing pond.
Mr. Nazzaro was present for the applicant. A detailed plan was displayed and reviewed.
Mr. Nazzaro noted two stockpile locations.

A Site Walk is scheduled for Fri., 1/31/20 at 3:30 p.m.

III.  CHAIRMAN’S REPORT

S. Robinson reported on a “field trip” with John McLeran and the presence of degraded wood chips.

Changes to the Open Space Plan in the final version of the Town Plan of Conservation & Development were reviewed.

S. Robinson commended the Garden Club for their bear awareness program.

Commissioners discussed ways to promote education and discuss re: open space.

D. Pattee noted receipt of an invoice re: unauthorized mowing and stated that proposals and pre-authorization are required before submitting invoices.

On the motion of T. Miller and the second of W. Perlman, the Commission voted unanimously to adjourn the meeting at 10:25 p.m.
