Tuesday, April 7, 2020
7:30 p.m. – Old Town House

Present via video: David Pattee, Chairman; Claire Matzke; William Hill; Stuart Green; Susan Robinson; Tina Miller; Wallace Perlman
Also present: Aimee Pardee, Land Use Director, via video

The Chairman called the meeting to order at 7:33 p.m.

I.   APPROVAL OF MINUTES -Meeting of March 17, 2020 – Cancelled

On the motion of W. Perlman and the second of S. Robinson, the Commission voted unanimously to approve the March 3, 2020 Minutes as amended:  Page 2, last paragraph above “Chairman’s Report”, change “ray” to “array”.

On the motion of W. Perlman and the second of W. Hill, the Commission voted unanimously to approve the March 8, 2020 Site Walk Inspections as submitted.

II.  REGULATORY

1.  Application #20-04, Nancy Pelz-Paget (owner), William Dexter (agent), 77 Stepney Road.  Received 3/03/2020.  Discussion and possible vote on an application for septic system repair within the regulated area.  Site Walk 3/08/2020.

Nancy Pelz-Paget and Mr. Dexter were present via video. Site Walk findings were reviewed.

On the motion of W. Perlman and the second of S. Robinson, the Commission voted unanimously to approve Application #20-04.

2.  Application #20-05, Arianit Krasniqi, 280 Ethan Allen Highway. Received 3/03/2020.    Discussion and possible vote on an application for construction of parking area, banquet hall, storage warehouse, and relocate drainpipe within the regulated area.  Site Walk 3/08/2020.

No one was present for the applicant.  Discussion tabled pending attendance by the applicant or representative.

3.  Application #20-06, Roger and Carolyn Lancaster (owners), LandTech (agent), 130 Topstone Road.  To receive and discuss an application for activities associated with a proposed 4-Lot subdivision to include Single Family Residences within the regulated area.

Tom Ryder and Curt Lowenstein were present via video for LandTech. Site Plans and maps were displayed and Mr. Ryder reviewed the proposal as it pertains to activities within the regulated area.  Mr. Ryder stated that there are no wetland impacts. Out of a total of 8-9 total acres, 13.6 acres are wetlands.  Mr. Hill requested details re: how much of the area is upland vs. wetland acreage.

Mr. Lowenstein reviewed the design elements of the proposal.  He noted receipt of a sign-off on the lots in concept from Doug Hartline.

A site walk is pending and will be delayed until further notice.  Discussion will resume at the next meeting in May.

4. Application #20-07, Fred A. Hernandez, 207 Poverty Hollow Road.  To receive and discuss an application to install a bathroom in existing garage requiring trenching from garage to septic within the regulated area.

Tom Quinn, Peak Engineering, provided a brief description of the proposal and noted that it is a one-day project.

A site walk is pending and will be delayed until further notice.  Discussion will resume at the next meeting in May.

5.   Application #20-08, Philip S. Curatilo and Tammy L. Weiner, 14 Whortleberry Road.  New residential construction to include asphalt driveway, drainage, tree removal, grading, topsoil and seed, and construct walls within 500 ft. of a delineated vernal pool.

Mr. Curatilo, Ms. Weiner and Tom Quinn of Peak Engineering were present via video. Mr. Quinn reviewed the proposal.  Susan Robinson noted that per the plan, over 60% of the trees on the lot are scheduled to be taken down. Mr. Quinn also noted the possibility of blasting due to the presence of ledge.

Re: drainage, Mr. Quinn stated that the vast majority of the watershed drains northwest away from the vernal pool. He added that watershed that drains toward the vernal pool is less than 3 acres. A. Pardee will review a possible drainage study and additional drainage requirements with Mr. Quinn.

A site walk is pending and will be delayed until further notice.  Discussion will resume at the next meeting in May.

Discussion of possible solar panel sites on open space parcels.  Discussion 3/03/2020.

D. Pattee stated that J. Pemberton is going to establish a committee. The area behind the dump and behind RES between the Community Center and the Town garage were noted as options.

6.  CHAIRMAN’S REPORT

Stuart Green spoke to the Land Trust ruling requiring that dogs be on a leash while on Land Trust property.

Susan Robinson reviewed the need for a location for the black swallow wort biocontrol.  Saugatuck Falls Natural Area was discussed as an option; however, the structure is 6” x 6”x 6” and needs to be left alone for one month. D. Pattee suggested a private piece of land.  S. Green suggested release on town property.

The next regular meeting on April 21 will be cancelled.

On the motion of T. Miller and the second of W. Perlman, the Commission voted unanimously to adjourn the meeting at 8:40 p.m.
