Minutes

Present: David Pattee, Chairman; Susan Robinson; William Hill; Stuart Green; Joseph Beres; Tina Miller; Wallace Perlman.

The Chairman called the meeting to order at 7:30 p.m.

  1. APPROVAL OF MINUTES -Minutes of 2/17/15

-Meeting of 3/3/15 – Cancelled

On the motion of W. Perlman and the second of W. Hill, the Commission voted to approve the 2/17/15 Meeting Minutes. S. Robinson abstained.

  1. REGULATORY

Application #14-18, Old Stone Estates (owner), P.W. Scott (agent), 12 Marchant Road and 55 Chestnut Woods Road. Received 12/2/14. Discussion and possible vote on an application for regulated activities associated with a proposed 14-lot subdivision. Site Walk 12/7/14. Discussion 1/6/15. Site Walk 1/11/15. Discussion 1/20/15. Public Hearing opened and closed 2/17/15.

Atty. Peter Scalzo and P.W. Scott were present for the applicant. Old and new plans were reviewed with respect to possible wetland impacts due to the plan revision. The Commissioners concurred that the revision does not change any impacts from the first application.

Atty. Scalzo submitted the Wetland Buffer Monitoring & Maintenance Plan dated 11/14.  T. Miller stressed the need for enforcement of the delineated plans.  Commission Counsel P. Olsen is working with Atty. Scalzo on deeds and easements.

On the motion of W. Perlman and the second of T. Miller, the Commission voted to approve Application #14-18 with the condition that: 1) the Conservation Easements be established, that satisfy the Commission to protect the wetlands, to be drawn up between the attorneys for the Commission and the applicant (the two attorneys) and; 2) the two attorneys will investigate and establish a suitable escrow account for maintenance of the stormwater management facilities that are common to the subdivision for the life of the permit.   S. Robinson abstained.

Application #15-02, Dennis Grimaldi/DMG Holdings (owner), Rich Grimaldi (agent), 13 Mountain Road. Received 1/20/15. Discussion and possible vote on an application to locate and rough out a driveway within the regulated area. Discussion 2/17/15.

Mr. Grimaldi and D. DiVesta were present.  Mr. DiVesta submitted new plans reflective of the application owner name.

A site walk is scheduled for Wed., 3/25/15 at 5:30 p.m. D. Pattee requested that stakes be placed at the proposed driveway location.

III.    CHAIRMAN’S REPORT

  1. Pattee noted receipt of a personal request from a resident to fund improvements on a Town-owned trail.  The item will be on the next agenda to hear a presentation on the proposal.

Re: Eric Flynn Patton’s request to film at Saugatuck Falls Natural Area, Police Chief Fuchs reviewed the information he received from Mr. Patton with D. Pattee.  D. Pattee reiterated that permission is granted to film as proposed at the 2/17/15 meeting, provided that the area remain open to the public.

  1. Green stated that 6/6/15 is the Trail Day Hike.  Trail routes are being developed.  The first portion of Old Mailcoach will be considered as a parking option if it is still a Town-owned road.
  1. Pattee updated the Commission on the proposed purchase of the Biehn property.

On the motion of T. Miller and the second of W. Perlman, the Commission voted unanimously to adjourn the meeting at 9:30 p.m.
