The Chairman called the meeting to order at 7:31 p.m.
I. APPROVAL OF MINUTES -Meeting of October 13, 2020
On the motion of D. Barrett and the second of S. Gagnon, the Commission voted unanimously to approve the 10/13/20 Meeting Minutes.
II. PUBLIC HEARING TO CONTINUE:
Application #528, 130 Topstone Road, Roger Lancaster & Carolyn L. Johnson Lancaster (owners), Curt Lowenstein/LANDTECH (agent). Proposed subdivision of 13.6 acres into 4 Lots. Received 8/25/2020. Public Hearing open 9/8/20 – completion date unknown pending possible reissue of executive orders. Continued 9/22/2020; 10/13/2020.
Mr. Lancaster was present via ZOOM in addition to Michael Ungerer, and Robert Pryor and Curt Lowenstein from LandTech.
Chairman Welles reviewed his discussion with Land Use Counsel Peter Olson re: combining the open lot with Lot 3 and creating an open space set-aside. Mr. Pryor stated that the site plans have been submitted along with a subdivision map showing the combined lots and conservation easement.
Mr. Welles asked if there will be an executed conservation easement or quitclaim deed conveying the title without encumbrances. Mr. Pryor stated that the conservation easement is over the parcel per Atty. Olson’s suggestion. Mr. Lancaster stated that the easement satisfies the open space requirement.
Mr. Welles noted the concern raised by John Hayes re: impact of construction vehicles on Topstone Road, a designated Scenic Road. Ms. Pardee noted that the Highway Department had been referred the application and had only raised concerns regarding drainage. Land Use Director A. Pardee stated that bonding is not required for private improvements.
On the motion of S. Gagnon and the second of A. Cumings, the Commission voted unanimously to approve Application #528 subject to the standard conditions of approval and also receipt of the remaining two documents, the Conservation Easement and Driveway Maintenance Agreement after approval of those documents by Commission Counsel Peter Olson.
Mr. Bacon commended the applicant for thoroughness and cooperation. A. Pardee will forward the requirements for mapping and filing to the applicant.
III. ADMINISTRATIVE
Reference Subdivision App. #513, 52 Mountain Road, Sean Keating, owner. Request to build a small art studio outside of the building construction and restriction line.
The addendum to Sub. App. #513 was reviewed. The Commission discussed a condition of approval limiting the septic size so the space cannot turn into an apartment.
Site walks will be on an individual basis. A. Pardee will send an email when the stakes are installed in the approximate location.
IV. CHAIRMAN’S REPORT/DISCUSSION
No discussion.
On the motion of S. Gagnon, the Commission voted unanimously to adjourn the meeting at 7:50 p.m.
