MINUTES
Tuesday, March 8, 2022
7:30 p.m. – VIA ZOOM

Present:  Dan Barrett, Chairman; Chuck Cilo, Alt., seated for S. Gagnon; Anda Cumings; Roger Van Ausdal; Regina O’Brien; Toby Welles, Alt.; James Bacon, Alt. at 7:38 p.m.
Absent: Steve Gagnon
Also present:   Aimee Pardee, Land Use Director

The Chairman called the meeting to order at 7:32 p.m.

I.                   APPROVAL OF MINUTES – Meeting of February 22, 2022
-Site Walk Minutes 2/24/22, Mr. and Mrs. William Bishop, 224 Umpawaug Rd.

The following changes will be made to the Minutes of February 22, 2022:  Page 1, last line, item 1, change “carried 4-1” to “carried 3-2”; Page 2, first sentence, second line, change “the error in fence height” to “the error in pillar height”; Page 2, second paragraph, last sentence, change to “Regina O’Brien stated that the pillars are incongruous with Umpawaug Road.” The Minutes were approved as amended. The 2/24/22 Site Walk Minutes at 224 Umpawaug Road were approved as submitted.

II.        REGULATORY
1.      Scenic Road Violation Updates:
-Application re: pillar lighting at 89 Cross Highway

No new information received.  Discussion will continue pending receipt of new information re: proposed lighting.
-Discussion re: 224 Umpawaug Road. Discussion 1/25/2022; 2/22/2022.  Site Walk 2/29/2022

Conor Daley, project contractor, was present via ZOOM. Site walk findings were reviewed. The Chairman noted the change from cobblestone to reclaimed granite pavers on the apron.
Mr. Van Ausdal motioned and Regina O’Brien seconded the motion to approve the change in site construction and leave the apron as changed.
Land use Dir. Pardee reviewed the zoning regulation of a maximum height of 8 ft. above grade for posts as well as the originally approved height of 6 feet per the Planning application. The pillars were measured at 8’6” according to A. Pardee.  Regina O’Brien questioned whether “fence posts” and pillars/piers are regarded as the same as they pertain to zoning regulations.
Mr. Daley will coordinate the placement of stakes so it can be determined if the posts are in the town right-of-way.  Mr. Welles noted if the posts are not in Planning jurisdiction, he is comfortable with the design as inspected in the field. Mr. Daley reported on additional items that need to be completed.

2.      Referral from Zoning:  486 Redding Road.  John Read Middle School, PTA.  Request for a Special Use Permit to hold a Craft Fair May 7, 2022.  Public Hearing to open March 9, 2022.
Mr. Cilo motioned and Mr. Van Ausdal seconded the motion to forward a positive response to Zoning.  The motion passed unanimously.

3.      Status/Progress Report from Regina O’Brien re the Gilbert & Bennett Committee.

Regina O’Brien updated the Commission on the status of the RFP to perform a Phase 1 Environmental Site Assessment.
