Present: Diane Taylor, Chairman; Thomas Flagg; Nancy King.

Absent: Jerry Sarnelli, Alt.; Donald Stroetzel; Toby Welles.

Also present: Jo-an Brooks, Land Use Coordinator
John Hayes, Town Planning Consultant

The Chairman called the meeting to order at 7:40 p.m.

I. APPROVAL OF MINUTES -Minutes 12/10/12
– Site Walk 12/12/12

On the motion of T. Flagg and the second of N. King, the Commission voted unanimously to approve the 12/10/12 Meeting Minutes as amended: Page 1, third paragraph under “Public Hearing Continued”, change “the Commission voted unanimously to accept:” to “the Commission voted unanimously to approve”; Page 1, fourth paragraph under “Public Hearing Continued”, change “the Commission voted unanimously to accept” to “the Commission voted unanimously to approve”.

After D. Taylor read the 12/12/12 Minutes into the record, N. King made a motion and T. Flagg seconded to unanimously approve the 12/12/12 Site Walk Minutes as submitted.

Subdivision Application #523, Costa Stergue, 24 and 25 Costa Lane. 14.5 acres into 6 lots. Received 9/25/12. Presentation 10/23/12. Public Hearing opened 11/27/12, continued 12/10/12,

Mr. Stergue was present along with Engineer J. Palmer and Atty. Neil Marcus. D. Taylor noted receipt of the following new information that was read and entered into the record:

-12/12/12 letter from Planning Commission to Atty. Marcus re: easement.
-12/12/12 letter from Planning Commission to J. Palmer.
-report from N. Burnham, Milone & MacBroom
-1/8/13 memo from J. Hayes

Mr. Palmer submitted and reviewed the solar design narrative. He will submit response questions to N. Burnham’s report for J. Brooks to forward. N. Marcus addressed comments in J. Hayes’ report. Planning Commission Counsel will be consulted re: issue of Town Road and submission of signed Conservation Easement.

D. Dooley, Costa Lane, questioned enforcement of remediation as outlined by the Conservation Commission and possibility of subdividing Lot 1 at a later date. L. Fitzgerald, Gallows Hill Road, submitted various letters and additional information re: vernal pool.

The Public Hearing will continue at the next meeting, 1/22/13.

Incentive Housing Zones. Discussion. Final review. Design Standards and recommendations for attachments to Zoning Regulations.

J. Hayes reported that he continues to work on illustrations with T. Welles and will submit final draft next week to the Subcommittee for approval.

Reference App. #505, Lot 3, Petra Koegel, owner, 16 Costa Lane. ZBA approved location of dog kennel and shed outside the Zoning setbacks. Location approved by Planning. To submit a map showing the adjusted Building Construction Restriction Line.
Reference Subdivision App. #391, Lot #8-A, 163 Sunset Hill Road, Kathlene Tracy. Request to create an additional driveway entrance.
Town Plan of Conservation & Development. Discuss recommendations for action.
Scenic Road Monitoring. Reports from Commissioners.

Reference App. #434, Lot 1SP, David Geil, owner, 5 Whortleberry Road. To submit as-built map adjusting the Building Construction Restriction Line to new building footprint approved by ZBA.

Commissioners noted the maps needed some corrections.

On the motion of N. King, the Commission voted unanimously to adjourn the meeting at 9:00 p.m.
