Present: Diane Taylor, Chairman; James Bacon; Michael Nostin, Alt., seated for T. Welles; Regina O’Brien, Alt., seated for N. King.

The Chairman called the meeting to order at 7:33 p.m.

I.     APPROVAL OF MINUTES –Meeting of 3/24/15  On the motion of J. Bacon and the second of R. O’Brien, the Commission voted unanimously to approve the 3/24/15 Meeting Minutes as corrected: Item II, second paragraph, third line, change “May 14, 2015” to “May 12, 2015.”

II.     CONTINUED. Subdivision Application #626, Willard and Catherine Rowley (owners), “Old Stone Estates LLC”, P.W. Scott Engineering & Architecture, PC (agent), 12 Marchant Road and 55 Chestnut Woods Roads. Proposed subdivision of 65.60 acres into 12 lots. App. #525 withdrawn at Meeting of 2/24/15. Received 3/10/15. Public Hearing scheduled for 5/12/15.

Willard Rowley, Atty. Peter Scalzo, Atty. Matthew Simon, P.W. Scott and Parker Coates were present for the applicant.

D. Taylor read the following statement into the record: “Before we start discussion of this application, I want to express on the record my concern that the applicant does not understand the Redding Planning Commission policy that any correspondence—either written or oral—between an applicant and anyone representing or reporting to the Redding Planning Commission MUST be done through the Land Use Office. In the future, we have advised our Commissioners, Consultants and Counsel that any materials received without being forwarded by the Land Use Office will be refused and returned to the sender without any action.”

J. Hayes noted receipt of a letter dated 3/25/15 from P. Scott addressing to his satisfaction three items re: driveways, entrance to driveways and parking spaces. Mr. Hayes requested a guiderail at Lot 8.

Mr. Rowley’s attorney, Matthew Simon, stated the need to resolve the issues concerning receipt of reports and outstanding archaeological testing.

Mr. Scott reported on his walk with S. Reeve re: recommendations for additional archaeological testing. Mr. Reeves noted that the walk was not an agreement but his advice on where appropriate high sensitivity areas were. Mr. Reeve recommended that CityScape walk and document all stone walls and other archaeological sites in the area.

C. Couch recommended additional test holes based on the presence of mill operations in the area and previous Joseph Sanford Jr. farm tract site.

Atty. Scalzo apologized for sending a letter directly to Commission Counsel. The basic historical reference reports will be amended and an additional report will be submitted after the additional testing. Mr. Couch and Mr. Reeve will be notified of the testing schedule and are invited to attend.

Atty. Scalzo submitted proposed deeds and easements. W. Rowley asked Mr. Couch if he had any additional items of concern. S. Reeve recommended consulting the Redding Grand List at the Town Clerk Office and J. Marchant’s probate inventory.

III.     ZBA Agenda, App. #15-01, 39 Orchard Drive, Peter and Deborah Mygatt. Request variance for 716 ft. to allow existing dwelling (historic Arrouet Theatre). RPC App. #163 to remain as accessory dwelling. DISCUSSION.

On the motion of M. Nostin and the second of J. Bacon, the Commission voted unanimously to send a positive response for the dwelling to be an accessory dwelling.

On the motion of M. Nostin, the Commission voted unanimously to adjourn the meeting at 8:45 p.m.
