Re: Proposed pool installation requiring modification of the Building and Construction Restriction Line (BRL).

We surveyed the proposed location for the new swimming pool, which was marked with surveying paint. Also marked were the 50 ft. zoning setback line, the location of the proposed pool fence, septic field and the pool pump and filtration unit. The location of the Zoning Setback Line abuts the applicants’ proposed location for the pool. The existing BRL passes diagonally through the proposed pool location, approximately bisecting the northern and western pool boundaries. Thus the northwesterly corner of the pool would lie outside of the current BRL. The BRL location seems to have been established at its current location due to the presence of steep slopes to the northwest of the proposed pool
location. In fact though, on-site slope measurements by me determined the slope in the area of the proposed construction are at 15% and even with necessary filling on the western end of the pool, it would be possible to not exceed 20% slope following construction. The pool contractor presented calculations that the pool at the most would be 1’8” above grade on the northwesterly corner. It was discussed that the approval of pool construction and any additional fill should be conditional on there not being creation of new slopes in excess of 20%.
The proposed placement of the pool pump and filtration unit was downslope enough so that it was in an area where the slope became 20%; the selection of an alternate location further upslope was recommended to the applicant and contractor.
The issue of the retaining wall proposed for the upslope end of the pool was also examined.
The applicant wants the retaining wall to be carried into the zoning setback area, but the BRL prevents this. The question of whether the BRL can be extended into the zoning setback area was discussed, but by a reading of SR. 8.1.36.2 it seems that the BRL cannot cross into the zoning setback area to permit wall building there. Clarification is needed, before the next meeting, since the proposed wall construction in the zoning setback area may normally be allowed by zoning ordinance.
The applicant does have a secondary plan for a wall following atop the pool perimeter if the wall cannot be built into the zoning setback area.
