Special Meeting Minutes

Attendance:

Region 9 Board of Education members: Mr. Mike D’Agostino, Ms. Cathy Gombos, Mr. Christopher Hocker, Mr. Todd Johnston, Mr. Walter King.

Administration:  Tom McMorran, Ed.D., Superintendent; Gina Pin, Ed.D., Assistant Superintendent & Head of School; Jennifer Desmarais, Assistant Principal; Julie McTague, Assistant Principal; Attorney Steven Sedor (for the Administration).

Others:  Parent #1, Parent #2, Stepmother of Student #1, Attorney Richard Mills (for the Board of Education).

Mr. D’Agostino called the Board of Education special meeting to order at 7:07 p.m. in JBHS Media Center.

Motion: To enter into Executive Session for the purpose of discussing confidential student records, and inviting in the following individuals:  Superintendent; Assistant Superintendent & Head of School; two Assistant Principals; Attorney for the Administration; Attorney for the Board of Education; Student #1; Parent #1; Parent #2.  Motion made by C. Gombos; seconded by W. King.  Approved. Unanimous.

EXECUTIVE SESSION was entered at 7:10 PM for the purpose of discussing confidential student records.

PUBLIC Session
Public Session was entered at approximately 7:20 p.m.

Motion: To enter into Executive Session for the purpose of discussing confidential student records, and inviting in the following individuals:  Superintendent; Assistant Superintendent & Head of School; two Assistant Principals; Attorney for the Administration; Attorney for the Board of Education; Student #1; Parent #1; Stepmother of Student #1.  Motion made by C. Gombos; seconded by W. King.  Approved. Unanimous.

EXECUTIVE SESSION was entered at approximately 7:25 PM for the purpose of discussing confidential student records.

PUBLIC Session
Public Session was entered at 9:30 p.m.

Motion:   MOVED, based on the evidence in the record, that the Board finds that on April 17, April 26 and April 27, 2017, Student #1 offered for sale or distribution a controlled substance on school grounds, in violation of Board Policy 5114(E).  The Board finds further that such conduct constitutes an offense for which expulsion is mandatory under Section 10-233d of the Connecticut General Statutes.  As a result of such conduct, the Board expels Student #1, effective immediately and continuing for a period of one calendar year, through May 11, 2018, subject to the following conditions:

1.  For the period through the end of the 2016-17 school year, the Board will permit Student #1 with an opportunity to complete the requirements necessary to graduate at the end of the 2016-17 school year and for that purpose will provide Student #1 with two (2) hours per week of alternative education for the two courses which he is required to pass in order to graduate at the end of the 2016-17 school year, subject to the following conditions:

a) Effective immediately and continuing through the end of the 2016-17 school year, Student #1 shall submit to weekly drug testing by an independent laboratory, at Student #1’s expense, and shall submit the results of all such tests to the Superintendent, with negative results for all such tests.

b) If during the 2016-17 school year Student #1 commits any suspendable or expellable offense and/or fails to comply with the drug testing provisions of this motion and/or has a positive drug test result and/or fails to comply with any other condition of this motion, Student #1 shall forfeit the right to the alternative education program set forth in this motion and shall forfeit the right to complete the requirements necessary to graduate at the end of the 2016-17 school year.

2.  During the expulsion period, Student #1 shall not be permitted to be on school grounds or attend any school-sponsored activities at any location, with the sole exception of his participation in the alternative education program. Student #1 will not be permitted to participate in the graduation ceremony in June 2017.
Motion made by C. Gombos; seconded by W. King.  Approved. Unanimous.

Motion: To adjourn the special meeting. Motion made by C. Gombos, seconded by T. Johnston.  Approved.  Unanimous.
