ZONING BOARD OF APPEALS

The meeting was called to order at 7:31 p.m.
APPROVAL OF ZONING BOARD OF APPEALS MINUTES:
Upon the Motion of Mr. Smith and second of Mr. Cooke, the December 20, 2016 Zoning Board of Appeals Meeting Minutes were approved (5-0) by the Board.
Application #17-01-01 –33 Olmstead Road –Owner Matthew Flanagan (Map #11 & Lot #94) – Request for variance to reduce Side Line (west) from 40’ to 9’; Side line (east) reduce from 40’ to 25’ and Rear Line; reduce setback from 50’ to 9’ for a Shed. Section 4.6.5 of the Redding Zoning Regulations requires 40’ feet from the side and 50’ feet from the front and rear. Variance requested is side line (west) 31’ feet; side line (east) 15’ feet; and rear line 41’ feet.
Mr. Matthew Flanagan presented the Application to the Board. He is requesting variance relief from side line setbacks on the east side and west side of the property, as well as the rear line setback for installation of a shed, 10 feet x 16 feet. The proposed location for the shed and requested variance is due to the non-conforming 0.63 acre lot, abnormal in shape, along with sloping topography and rocky terrain. Mr. Flanagan noted that the surrounding neighbors are in support of the proposed location for the shed. He presented photos of the property to the Board members pointing out the rock ledge and sloping topography indicating that the neighbor’s view of the shed would be obscured.
Ms. Williams inquired about the details of the shed. Mr. Flanagan noted that the shed had not yet been purchased but he planned to install a 10 x 16 foot, prefabricated shed. Mr. Given asked if the shed was to be set on blocks. Mr. Flanagan noted he plans to dig out the area to create a stable landing for the shed. Ms. Williams asked if Mr. Flanagan could give further details regarding the hardships relating to the lot lines and shape and topography. Mr. Flanagan reviewed the surveys of the property with the Board members pointing out the backyard area where there is a row of hemlocks and boulders and rocks along with downhill sloping at the rear of the property. Mr. Flanagan noted that the property was part of a trade with adjoining lots ten years ago thereby creating the abnormal lot size and shape. Ms. Williams remarked for the record that Aimee Pardee, the Redding Zoning Enforcement Officer, had previously provided historical data and surveys regarding the property lot and adjoining lots to the Board members. Ms. Whaley noted concern as to whether the proposed shed would be considered a temporary structure and Ms. Williams noted that the structure was too large and would require variance. Ms. Williams read the letters of support into the record from the adjoining neighbors: Mr. and Mrs. Lloyd Sturges at 40 Olmstead Road; Mr. Michael Conroy at 27 Olmstead Road; and Mr. and Mrs. Pennell at 44 Olmstead Road.
Upon motion of Mr. Given and second of Mr. Cooke, the Board voted to enter deliberative session at 7:47 p.m.
Application #17-01-01 –33 Olmstead Road –Owner Matthew Flanagan – Upon motion of Mr. Cooke and the second of Mr. Given, the Board voted 5-0 to approve the application for variance to reduce the side line setback on the west from 40 feet to 9 feet, reduce the side line setback on the east from 40 feet to 25 feet, and rear line set back from 50 feet to 9 feet for the installation of a 10 foot x 16 foot shed not on a foundation but on prepared ground.
Upon motion of Mr. Given and second of Mr. Cooke, the Board voted to exit deliberative session at 7:48 p.m.
The Board voted unanimously to adjourn at 7:49 p.m.
