ZONING BOARD OF APPEALS
MEETING MINUTES
AUGUST 15, 2017 – 7:30 P.M.
TOWN HALL HEARING ROOM

Present:
Henry Polio, Secretary; Bruce Given; Noel Cooke; Jill Cilo, Alternate; Daniel Barrett, Alternate; and Trevor Furrer, Alternate

Absent:
Beth Williams, Chairman; Scott Smith

The meeting was called to order at 7:30 p.m.

APPROVAL OF ZONING BOARD OF APPEALS MINUTES:
Upon the Motion of Mr. Barrett and second of Ms. Cilo, the July 18, 2017 Zoning Board of Appeals Meeting Minutes were approved (5-0) by the Board. Mr. Given abstained from voting.

REGULAR APPLICATIONS:
Application #17-08-01 – 98 Picketts Ridge Road –Owner: Adam R. Lanehart – Applicant Frederick V. Miller Sr. (Map #11 & Lot #13) – Request to appeal – Seeking to be granted approval to construct a house at 98 Picketts Ridge Road, Redding, CT; (zoning enforcement officer concluded that no zoning permit may be granted, per memo to file re: 98 Picketts Ridge Road dated 12/1/16).

Mr. Polio explained at the onset there were two issues to consider in regards to the application for appeal: First, the Board would need to hear cause for the untimeliness of the filing for appeal and, if the Board decided to continue, then, secondly, discussion regarding the Applicant’s request to appeal the Zoning Enforcement Officer’s decision could be heard.

Mr. Frederick Miller Sr. gave a historical perspective of his life in Redding over the years and his involvement in the community and business district. He explained that during the original settlement and division of the property a condo doctrine was created.

Mr. Polio noted that additional information regarding the property history could be heard once the Board decided upon the untimely filing. Attorney for the Applicant, Mr. Robert Fuller, inquired as to the timeline of the application. Mr. Polio indicated that the timeline began when the Town’s Attorney sent a response letter to Mr. Fuller on May 16th, 2017. The filing of the Appeals Application would have been required within 30 days, by June 16th, 2017. However, the Application was filed on July 10th, 2017. Mr. Fuller noted he was unaware that there was an untimeliness in the filing process.

Upon motion of Mr. Cooke and second of Mr. Given, the Board voted to enter deliberative session at 7:44 p.m.

DELIBERATIVE SESSION:
Application #17-08-01 98 Picketts Ridge Road – Owner: Adam R. Lanehart –
Upon motion of Mr. Cooke and the second of Mr. Barrett, the Board voted 6-0 to deny the application for appeal without prejudice due to the untimeliness of the filing and recommend that the Applicant re-apply to Zoning and follow the proper permitting process and timeline.

Upon motion of Mr. Cooke and second of Mr. Barrett, the Board voted to exit deliberative session at 7:47 p.m.

Mr. Polio explained to the Applicant and attorney the recommendation to apply for a zoning permit and seek approval from the Zoning Department and then re-apply to the Zoning Board of Appeals as may be required within the proper timeframe. Mr. Fuller indicated that they will comply with the request and may request a variance simultaneously.

ADJOURNMENT
The Board voted unanimously to adjourn at 7:50 p.m.
