MEETING MINUTES
JANUARY 19, 2016—7:30 P.M.

The meeting was called to order at 7:31 pm.

APPROVAL OF ZONING BOARD OF APPEALS MINUTES:

Upon the Motion of Mr. Smith and second of Mr. Given, the November 17, 2015 Zoning Board of Appeals Meeting Minutes were approved (5-0) by the Board.

REGULAR APPLICATIONS:

Application 16-01-01 – 475 Newtown Turnpike (formerly 327 Blackrock Tpke.) – Owner: Sterlhen LLC/Marie C. Henry (Map #16 & Lot #86): Requesting variance from Section 3.6 of the Redding Zoning Regulations to construct residence outside of the minimum rectangle.

Ms. Marie Henry presented the application to the Board, proposing to place an accessory temporary dwelling outside the minimum rectangle while a primary residence is built. Ms. Henry explained that once the primary residence is completed the accessory dwelling would become office space.   The property is 5.3 acres in size and faces Black Rock Turnpike although the entrance had been changed to Newtown Turnpike with an existing, approved driveway.  Ms. Whaley inquired as to the distance of the proposed structure to the property line and Ms. Henry indicated that it was at least 500 feet.  Mr. Polio asked what the intended time line was for construction of the main house and Ms. Henry stated one to two years.   Mr. Polio made note that while a time line is in place for the construction of the primary dwelling it is conceivable, due to unforeseen circumstances, such as financial or otherwise, that it may not be built and this accessory structure would become the primary structure.

The Board members reviewed areas on the map with Ms. Henry and asked about an alternate location within the rectangle. Ms. Henry indicated that per the engineer an alternate location could be in the upper left corner of the rectangle although due to wetlands there is limited access to the area.

Ms. Colette Griffin of 477 Newtown Turnpike, an adjacent neighboring property, was present and voiced concerns as to what type of structure was being built as there is currently four large shipping containers located on the property. Ms. Henry indicated that the proposed accessory structure is to be built using the shipping containers, three containers on the ground level and one container on the second level.  Ms. Henry stated the finished structure will not look like shipping containers once complete and will have proper siding installed, and will ultimately become office space after the primary residence is complete.

Upon motion of Mr. Smith and second of Mr. Given, the Board voted to enter deliberative session at 7:45 p.m.

DELIBERATIVE SESSION:

Application 16-01-01 – 475 Newtown Turnpike (formerly 327 Blackrock Tpke.) –Upon motion of Mr. Smith and the second of Mr. Given, the Board voted 5-0 to deny the application without prejudice due to a revised plan forthcoming for placement of the accessory structure at an alternate location within the buildable area.

Upon motion of Mr. Smith and second of Mr. Polio, the Board voted to exit deliberative session at 7:48 p.m.

ADJOURNMENT

The Board voted unanimously to adjourn at 7:48 p.m.
