Applicants

1. Call meeting to order

Chair Williams called the meeting to order at 7:30PM.

2. Approval of September 15, 2020 Zoning Board of Appeals Meeting Minutes & Motions.

MOTION:  Mr. Cooke made a motion to approve the minutes of the ZBA meeting held on Tuesday, 9/15/2020. Ms. Cilo seconded the motion.

Chair Williams asked for Brian Matzke to be noted as a full member of the ZBA.

The vote was unanimous, and the motion carried.

3.  Public Hearings

Application #20-07-01 – 207 Redding Road (Map #42 & Lot #65) – Owner Kyle & Jessica Finn – Request for a variance to reduce side yard setback from 40’ feet to 25’ feet and to reduce rear set back from 50” to 15’ to convert a 1 Bay Garage into a 2 Bay Garage.  Town of Redding Zoning Regulations 4.6.5.  Continuation from September 15, 2020 as owner obtained a new A-2 survey.

Chair Williams asked Mr. Finn about the dimensions provided on his survey versus what was advertised on the agenda. Chair Williams said this item cannot be heard if there is a discrepancy between these two items.

Application #20-12-01 –  45 Picketts Ridge Road (Map #11 & Lot #137) – Owner Jon C. (Chris) Hocker & Deborah A. Haws – Request for a variance to reduce front yard setback from 50’ to 32’  feet for a Generator. Town of Redding Zoning Regulations 4.6.5.  Variance requested 18’ feet.

Mr. Hocker addressed the ZBA. He said his home is legally non-conforming which results in a hardship. The proposed location of the generator wouldn’t not be compliant with Zoning regulations.

Discussion followed concerning the generator and where it could be placed.

Application #20-12-02 – 44 Stepney Road (Map #24 & Lot #18) – Owner Howard Sherman – Request for a variance to reduce side yard setback from 40’ to 35’ feet for a Generator.  Town of Redding Zoning Regulations 4.6.5.  Variance requested 5’ feet.

Mr. Sherman addressed the ZBA. His home is also legally non-conforming. He stated that his property being non-conforming as well as his health situation are his hardships.

Chair Williams stated that a person’s health is not considered a hardship per the Zoning regulations. Variances are granted for the home, not the occupant.

Discussion followed concerning the generator and its proposed location.

MOTION:  Mr. Cooke made a motion to exit the Public Hearing and move to Deliberative Session. Mr. Smith seconded the motion. The vote was unanimous, and the motion carried.

Deliberative Session

Application #20-07-01 – 207 Redding Road (Map #42 & Lot #65) – Owner Kyle & Jessica Finn –

Chair Williams said the ZBA is hitting a statutory limit with this application. The information advertised is different than what was presented. If the ZBA denies this application without prejudice, the applicants will be able to resubmit their application accurately and without fees.

MOTION:   Ms. Cilo made a motion that Application #20-07-01 – 207 Redding Road (Map #42 & Lot #65) – Owner Kyle & Jessica Finn – Request for a variance to reduce side yard setback from 40’ feet to 25’ feet and to reduce rear set back from 50” to 15’ to convert a 1 Bay Garage into a 2 Bay Garage.  Town of Redding Zoning Regulations 4.6.5., be denied without prejudice due to inaccurate data being advertised publicly. Mr. Cooke seconded the motion. The vote was unanimous, and the motion carried.

Application #20-12-01 –  45 Picketts Ridge Road (Map #11 & Lot #137) – Owner Jon C. (Chris) Hocker & Deborah A. Haws –

The ZBA discussed Zoning regulations concerning generators and how they are impacting the decisions the ZBA can make.

MOTION:  Mr. Cooke made a motion that Application #20-12-01 – 45 Picketts Ridge Road (Map #11 & Lot #137) – Owner Jon C. (Chris) Hocker & Deborah A. Haws – Request for a variance to reduce front yard setback from 50’ to 32’ feet for a Generator. Town of Redding Zoning Regulations 4.6.5.  Variance requested 18’ feet, be denied for lack of a stated hardship. Mr. Matzke seconded the motion. There were four yes votes (Williams, Cooke, Cilo, and Matzke) and one no vote (Smith). The motion carried.

Application #20-12-02 – 44 Stepney Road (Map #24 & Lot #18) – Owner Howard Sherman

Chair Williams says the Zoning Commission must review their generator policy. The ZBA will produce a letter stating this.

MOTION:   Mr. Matzke made a motion that Application #20-12-02 – 44 Stepney Road (Map #24 & Lot #18) – Owner Howard Sherman – Request for a variance to reduce side yard setback from 40’ to 35’ feet for a Generator.  Town of Redding Zoning Regulations 4.6.5.  Variance requested 5’ feet, be denied for lack of hardship. Mr. Cooke seconded the motion. There were three yes votes (Williams, Cooke, and Matzke) and two no votes (Cilo and Smith). The motion carried.

 MOTION:   Ms. Cilo made a motion to leave deliberative session. Mr. Cooke seconded the motion. The vote was unanimous, and the motion carried.

4. Possible Discussion/Administrative Matters.

Ms. Cilo said the ZBA should ask the Zoning Commission to review their regulations concerning generators.

5. Adjournment

MOTION:   Ms. Cilo made a motion to adjourn. Mr. Cooke seconded the motion. The vote was unanimous, and the motion carried.

The meeting was adjourned at 8:43PM.
