1. Call meeting to order
Chair Williams called the meeting to order at 7:28PM.
2. Approval of December 15, 2020 Zoning Board of Appeals Meeting Minutes & Motions.
MOTION:
Mr. Smith made a motion to approve the minutes of the ZBA meeting held on Tuesday, 1/15/2021. Mr. Cooke seconded the motion.
Chair Williams asked for two edits to the minutes:
In section 3, Public Hearings, under Application #20-12-01, the sentence, “The proposed location of the generator wouldn’t not be compliant with Zoning regulations”, should be changed to, “The proposed location of the generator wouldn’t be compliant with Zoning regulations.”
In Section 3, Public Hearings, in the Deliberative Session, the motion for Application #20-12-01 needs to be edited. Jill Cilo voted no on the motion for this application. This motion had three yes votes (Williams, Cooke, and Matzke) and two no votes (Cilo and Smith).
The vote was unanimous, and the motion carried.
3. Public Hearings
a. Application #21-01-01 – 207 Redding Road (Map #42 & Lot #65) – Owner Kyle & Jessica Finn – Request for a variance to reduce side yard setback from 40’ feet to 22.8’ feet and to reduce rear set back from 50’ to 12.5’ to convert a 1 Bay Garage into a 2 Bay Garage. Town of Redding Zoning Regulations 4.6.5.
Chair Williams asked Mr. Finn if this application will increase non-conformity. Discussion followed concerning additions to a non-conforming structure and how zoning regulations apply.
Mr. Finn explained how the topography of his property makes siting a 2-bay garage unfeasible except for the requested location.
4. Approve ZBA Calendar Meetings for 2021
MOTION:
Mr. Smith made a motion to approve the calendar meetings. Mr. Cooke seconded the motion.

MOTION:
Mr. Smith made a motion to move to deliberative session. Ms. Cilo seconded the motion. The vote was unanimous, and the motion carried.
Deliberative Session:
Chair Williams said the homeowner has a topographical hardship. Mr. Smith agreed with Chair Williams.
Chair Williams said this addition does not further encroach on any property lines. Ms. Cilo agreed with Chair Williams.
Mr. Cooke said zoning regulations apply the same to this property as they do for other properties. Topography is reflected in the price of the home and economic disappointment is not covered under the appeals process.
MOTION:
Mr. Smith made a motion to approve Application #21-01-01 – 207 Redding Road (Map #42 & Lot #65) – Owner Kyle & Jessica Finn – Request for a variance to reduce side yard setback from 40’ feet to 22.8’ feet and to reduce rear set back from 50’ to 12.5’ to convert a 1 Bay Garage into a 2 Bay Garage. Town of Redding Zoning Regulations 4.6.5. with reasons having to do with property size, shape, and topography. Ms. Cilo seconded the motion.
The vote was four yes votes (Williams, Smith, Cilo, and Matzke) and one no vote (Cooke). The motion carried.
5. Possible Discussion/Administrative Matters.
Chair Williams discussed the recent Zoning Commission meeting and the letter that she wrote concerning generator regulations.
Discussion followed concerning what next steps the ZBA can take to address generator regulations.
6. Adjournment
MOTION:
Mr. Smith made a motion to adjourn the meeting. Mr. Cooke seconded it. The vote was unanimous, and the motion carried.
The meeting adjourned at 7:59PM.
