1. Call Meeting to Order
Chair Williams called the meeting to order at 7:34PM.

2. Approval of the Tuesday, 10/19/2021 Zoning Board of Appeals Meeting Minutes & Motions.

MOTION:

Mr. Smith made a motion to approve the minutes and motions of the Tuesday, 10/19/2021 Zoning Board of Appeals Regular Meeting. Ms. Cilo seconded the motion. The vote was unanimous, and the motion carried.

3. Public Hearing


Application #11-01-21: 78 Mountain Road (Map #41 & Lot #15) Owner: Gregory and Michele Van Steinburgh:

Request for a variance for addition to reduce rear yard setback from 50’ feet to 45.9’ feet and at one corner of the addition from 50’ feet to 42.9’ feet at the other. Town of Redding Zoning Regulations Section 4.6.

Request for a variance for addition to reduce side yard setback from 50’ fee to 45.9’ feet and at one corner of the addition

Michele Van Steinburgh addressed the ZBA.

The reason for the addition is to build a bedroom for their son. The lot is a sub-standard size and is irregularly shaped. There are wetlands in the western part of the property and the front of the house has a significant slope. The eastern part of the property has an existing pool. The preferred location of this bedroom would be on the rear of the house taking the place of part of the existing deck.

A lengthy discussion followed concerning various adjustments to the addition and other possible locations on the property where the addition would comply with setbacks.

MOTION:
Mr. Smith made a motion to move to deliberative session (8:19PM). Vice Chair Cooke seconded the motion. The vote was unanimous, and the motion carried.

Deliberative Session

Mr. Smith made a statement about the function of the ZBA and its authority. He stated that the ZBA’s purpose is to solve zoning issues that were unanticipated when the Zoning Regulations were created.

Chair Williams stated that denying this application without prejudice will allow the applicants to revisit this application with more information and alternatives. The wetland survey may assist in an approval of this application.

MOTION:
Mr. Smith made a motion to deny without prejudice, Application #11-01-21: 78 Mountain Road (Map #41 & Lot #15) Owner: Gregory and Michele Van Steinburgh: Request for a variance for addition to reduce rear yard setback from 50’ feet to 45.9’ feet and at one corner of the addition from 50’ feet to 42.9’ feet at the other. Town of Redding Zoning Regulations Section 4.6., so that the applicants can receive a site survey to demarcate their wetlands. The applicants must return to the ZBA within 60 days with their results. Vice Chair Cooke seconded the motion. The vote was four yes votes (Williams, Cooke, Smith, and Cilo) and one no vote (Matzke). The motion carried. Vice Chair Cooke stated that he would have liked to hear from the neighbor to ensure the ZBA was working within the state statutes. Discussion followed about the importance of working within statutes.

MOTION:
Vice Chair Cooke made a motion to leave deliberative session. Ms. Cilo seconded the motion. The vote was unanimous, and the motion carried.

4. Possible Discussion/Administrative Matters

There was no discussion or administrative matters to address.

5. Adjournment

MOTION:
Mr. Smith made a motion to adjourn the meeting. Mr. Matzke seconded the motion. The vote was unanimous, and the motion carried.

The meeting was adjourned at 8:35PM.
