Minutes

Present:  Gerry Casiello, Chair; Amy Atamian, Ben Gordon, Mike Hoffman, Ted Ogonek, and alternates, Matthew Lecher, and Gary Miyashiro

Also present:  Aimee Pardee, ZEO, and a representative of the Redding Pilot

Mr. Casiello called the regular meeting to order at 7:35 pm.

All regular member of the Commission were seated.

REGULAR MEETING

  1. Approval of Minutes: Motion: move to accept the minutes of the Regular Meeting of February 26, 2014 as corrected. Hoffman, Ogonek.   Approved unanimously

Correction:  page 3 under Discussion of Representative for the Historic Review Committee, the last sentence should read as follows:   Following discussion, Mr. Casiello did not appoint a representative to the Historic Review Committee but noted that, until a representative is appointed, The Chairman and the Zoning Enforcement Officer would be available to the Committee on an advisory basis.

  1. Town of Redding Zoning Commission: Commission initiated application for amendment of The Redding Zoning Regulations Section 6.2: to remove the following text:

If a building or structure, 50 – years or older, is to be demolished, no demolition shall

occur for 90 days after application for a demolition permit.  Demolition must be legally

noticed.  At the conclusion of the ninety-day period the demolition permit shall be issued and the demolition may occur.

Reason for removal: regulation conflicts with the recently approved Demolition Delay Ordinance.

Motion: move that the Redding Zoning Commission approve the removal of text from Section 6.2 of the Redding Zoning Regulations as discussed.  Atamian, Ogonek.  Approved unanimously.

  1. Application #14-06Z – In accordance with Section 5.11.2 of the Redding Zoning Regulations: application to renew a Limited Duration Special Use Permit for the Redding Boy Scout Troop #15 Annual Spaghetti Dinner to be held on Saturday May 3, 2014 from 4:45pm thru 8:00pm at the West Redding Volunteer Fire Dept. Fire District #2, 306 Umpawaug Road.  Previously held on May 5, 2013.

Motion: move that the Redding Zoning Commission approve Application #14-06Z and waive the application fee.  Hoffman, Ogonek.  Approved unanimously.

  1. Application #14-07Z – In accordance with Section 5.11.2 of the Redding Zoning Regulations: application to renew a Limited Duration Special Use Permit for the First Church of Christ Congregational 33rd Annual Church Fair to be held on Saturday September 27, 2014 from 10:00am thru 4:30pm.   Previously held on September 28, 2013.

Motion: move that the Redding Zoning Commission approve Application #14=07Z  and waive the application fee.  Hoffman, Ogonek.  Approved unanimously.

  1. Application #14-08Z – In accordance with Section 5.12 of the Redding Zoning Regulations:  application to construct residential apartment within existing dwelling.  Emily and Joshua Kilbourn,   20 Deacon Abbott Road, Redding.

Motion: move that the Redding Zoning Commission set April 9, 2014 for a Public Hearing on Application #14-08Z.  Ogonek, Hoffman.  Approved unanimously.

  1. DISCUSSION:

Three Levels Corporation et al vs. Conservation Commission of the Town of Redding.

Discussion of recent court decision affirming denial of application for multi-family development at 626 Redding Road and Gallows Hill Road as grounds for invalidation of Redding Zoning Commission approval of Site Plan Application under CGS 8-30.g in accordance with stipulated agreement approved by the commission at the regularly scheduled meeting of March 26, 2008; stipulated agreement April 10, 2008.

The Commission reviewed the Stipulated Agreement regarding 626 Road, in particular that the agreement provided that Site Plan and Special Permit approval would only become effective if approval for the project was also obtained from the Conservation Commission.  As the Appellate Court has now affirmed the Conservation Commission’s denial of the project, the Commission determined that the Site Plan and Special Permit approval is invalidated.

  1. FUTURE AGENDA : March 26 2014: Public Hearing re:
  2. a) Redding Garden Club 175h Annual Plant Sale-New Location
  3. b) New Pond Farm “New Pond Farm’s Hunt for the Hens” tour of in-town chicken coops
  4. c) New Pond Farm Site Plan revision to construct an approximately 200 square foot standing storage building.
  1. COMMUNICATIONS: A letter was received from Ronald S. Gass and L. Johnanna Pfund regarding the proposed cellular communication facility at 186 Black Rock Turnpike.

Motion: move to adjourn the meeting.  Gordon, Hoffman.  Approved unanimously.

The meeting adjourned at 7:48 pm

PUBLIC HEARING

Mr. Casiello called the Public Hearing to order at 7:30 pm and called on Mr. Gordon to read the call of the meeting.

Call of the Meeting

Mr. Gordon read the call of the meeting.

Motion: move to accept the Call of the Meeting.  Ogonek, Atamian. Approved unanimously.

The purpose of the action to be taken is in response to the newly adopted Demolition Delay Ordinance. The new Ordinance requires that Section 6.2 of the Redding Zoning Regulations be edited to remove the following text portion:

ZEO Pardee noted that correspondence was received from the Greater Bridgeport Regional Panning Agency, SWRPA, and HVCEO stating that the issue was a local issue with no impact, and agreement from the Planning Commission.Motion: move to close the Public Hearing.  Gordon, Atamian.  Approved unanimously.

The Public Hearing was closed at 7:35 pm.
