Minutes

Present:  Gerry Casiello, Chairman; Amy Atamian, Secretary; Commissioner Matt Lecher; Commissioner Ted Ogonek; Commissioner Paul Scholl; Alternate Gary Miyashiro, unseated.

Also Present:  Aimee Pardee, Zoning Officer; Applicant John Marfia; Applicant Joe Bonomo, President, Redding Historical Society; two Boy Scouts with parents.

The Chairman called the meeting to order at 7:30 p.m.

PUBLIC HEARING
Application #2016-04Z – Owner:  John T. Marfia, 47 Pine Mountain Road (Assessor’s Map #41 & Lot #57) In accordance with Section 5.5.3 of the Redding Zoning Regulations request for a Special Permit for earth moving in excess of 300 cubic yards of material.  Received January 13, 2016: Public Hearing February 24, 2016.

Ms. Atamian read the call for the hearing.  On the motion of  Mr. Lecher and the second of Mr. Ogonek, the commission voted unanimously to accept the call and open the public hearing.

The chairman asked Mr. Marfia to come forward and explain his application.  Mr. Marfia explained that his back yard has an area that drops off, then rises again leaving a dip that he had filled last year with 17 truckloads of fill.  He said he had another 3 loads of topsoil brought in to dress the fill but he hasn’t spread that out.  Once he learned that he needed a permit for the work, he stopped and brought in his application to the commission.  The chairman asked about stabilization of the soil; Mr. Marfia stated that he will seed it when the topsoil is spread, and that he also plans to plant some trees.  He asked about the stabilization of what is there; Ms. Pardee stated that she had looked at the soil that is in place. She said that it looked like pond dredging material and that is had hardened up but that, once topsoil was spread, there should be erosion control measures installed until grass is established.

The Chairman opened the hearing to public comment.  Wendy Halpurn asked if neighbors are notified regarding applications such as this one; Ms. Pardee stated that letters had gone to all abutting neighbors, via Certified Mail, explaining the application and giving the date and time of the hearing.

The commission discussed the application and reviewed the required findings.  The chairman read a memo from Jo-An Brooks, Land Use Coordinator, and comments from John Hayes, Planning Consultant.

Hearing no further comments or discussion, the chairman suggested closing the public hearing.  Mr. Ogonek moved that the hearing be closed, Ms. Atamian seconded, and the motion to close the hearing carried unanimously.  The hearing was closed at 7:43 p.m.

REGULAR MEETING
1.  Approval of Minutes
: Public Hearing and Regular Meeting of January 27, 2016.

On the motion of Mr. Ogonek and the second of Ms. Atamian, the commission voted to accept the minutes of the Public Hearing and Regular Meeting of January 27, 2016.

2.  Application #2016-04Z – Owner: John T. Marfia, 47 Pine Mountain Road (Assessor’s Map #41 & Lot #57) In accordance with Section 5.5.3 of the Redding Zoning Regulations request for a Special Permit for earth moving in excess of 300 cubic yards of material.

The commission discussed Mr. Marfia’s project.  They noted that the project seems to be in keeping with the intent of the regulations and that it does seem to have impacted the neighbors.  The stabilization of the material was discussed, as well as the time frame for the project.

Mr. Lecher made a motion that, as soon as the weather permits, Mr. Marfia should spead the topsoil over the fill and seed it, while maintaining erosion control measures until the Zoning Officer finds that the site has been stabilized.  Mr. Ogonek seconded the motion and it was carried unaimously.

3.  Application #2016-07Z -In accordance with Section 5.11.2 of the Redding Zoning Regulations: Application for a Limited Duration Special Use Permit for Georgetown Village Restoration to hold its fourteenth Annual Georgetown Day on Sunday June 12, 2016 from 12:00pm to 6:00pm on Main Street in Georgetown.   Previously held June 14, 2015.

The chairman noted that this event has been held for thirteen years previous to this year and that the event was popular and very well run.  On the motion of Ms. Atamian, and the second of Mr. Ogonek, the commission voted unanimously to grant the Limited Duration Special Use Permit for Georgetown Day.

4.  Application #2016-08Z – In accordance with Section 5.11.2 of the Redding Zoning Regulations: Application for a Limited Duration Special Use Permit for Redding Garden Club to hold its ”Annual Plant Sale” at Lonetown Manor Museum & Historical Site, 43 Lonetown Road (Assessor’s Map #21 & Lot #42) on Saturday May 7, 2016 from 9:00am thru 2:00pm.  Previously held May 9, 2015.

The chairman noted that the garden club has been running their plants sale for many years without any problems and that had successfully moved the sale from the Town Green to Lonetown Manor.  On the motion of Ms. Atamian, and the second of Mr. Lecher, the commission voted unanimously to grant the Limited Duration Special Use Permit to the Redding Garden Club.

5.  Application #2016-09Z – In accordance with Section 5.11.2 of the Redding Zoning Regulations: Application for a Limited Duration Special Use Permit for the Redding Historical Society to hold its “Redding Custom and Collector Car Show 2016” at 43 Lonetown Road (Assessor’s Map #21 & Lot #42) on Saturday June 18, 2016 from 9:00am thru 4:30pm with a rain date of Sunday June 19, 2016 from 10:00am thru 5:30pm.  Previously held September 10, 2011

The chairman noted that it has been several years since the Historical Society has hosted a car show, but that they had done the car show several times with success and that the regulations do not stipulate a time frame for discontinuance of an event after which it would be considered a new event.  He stated that he felt the commission could take action regarding this event at this evening’s meeting.

On the motion of Mr. Scholl, and the second of Ms. Atamian, the commission voted unanimously to grant the Limited Duration Special Use Permit to the Redding Historical Society.

6.  DISCUSSION: The chairman and Ms. Pardee briefly reviewed with the commission the Supreme Court case Reed vs. Gilbert, about which they recently attended a talk. They explained that this court case will require a re-write of the regulations regarding signs as the regulations must be content neutral.

9.  ADJOURNMENT: On the motion of Mr. Ogonek, and the second of Ms. Atamian, the commission voted unanimously to adjourn at 7:52 p.m.
