Regular Meeting Minutes
December 12, 2018 – 7:30 p.m.
Town Hall Hearing Room
100 Hill Road, Redding, Connecticut

Present: Gerry Casiello, Chairman; Matt Lecher, Vice Chairman; Amy Atamian, Secretary; Commisioner Ted Ogonek; Alternate Gary Miyashiro.

Also Present: Aimee Pardee, Zoning Officer; applicants.

The Chairman called the meeting to order at 7:30 p.m., seating Mr. Miyashiro for Commissioner Paul Scholl.

PUBLIC HEARING:
Application #18-20Z – 150 Lonetown Road (Assessor’s Map #7 & Lot #10) Louis Weinkle & Suzanne Meyers – Request for a Special Use Permit for an accessory apartment in accordance with Section 5.12 of the Redding Zoning Regulations. Received November 14, 2018: Public Hearing December 12, 2018.

Ms. Atamian read the call for the Public Hearing. On the motion of Mr. Ogonek and the second of Mr. Lecher, the Commission voted unanimously to accept the call and open the public hearing.

The Chairman reviewed the application, along with Section 5.12 of the regulations, and stated that the proposal appeared to meet the requirements of the regulations. He then read into the record correspondence from the Redding Health Department and the Planning Commission. The applicants spoke, explaining that they planned to use the apartment as guest quarters and possibly as an occasional Air Bnb type rental. Hearing no further questions or comments, Ms. Atamian moved that the hearing be closed. Mr. Ogonek seconded the motion and it was carried unanimously, closing the hearing at 7:35 p.m.

The Chairman noted that this application had been withdrawn.

REGULAR MEETING:
1. Approval of Minutes: Regular Meeting Minutes of November 14, 2018.

On the motion of Mr. Ogonek and the second of Mr. Lecher, the Commission voted by majority to accept the minutes as written; Ms. Atamian abstained from the vote as she was not present at the meeting.

2. Application #18-20Z – 150 Lonetown Road (Assessor’s Map #7 & Lot #10) Louis Weinkle & Suzanne Meyers – Request for a Special Use Permit for an accessory apartment in accordance with Section 5.12 of the Redding Zoning Regulations. If public hearing is closed, for discussion/action.

The Commission briefly reviewed the application. On the motion of Ms. Atamian and the second of Mr. Ogonek, the Commission voted unanimously to approve application 18-20Z.

3. Application #18-21Z – 38 Goodridge Road (Assessor’s Map #17 & Lot #22) Bree DePalo – Request for a Special Use Permit for an accessory apartment in an existing accessory building, in accordance with Section 5.12 of the Redding Zoning Regulations. To receive; set public hearing date.

The Commission reviewed the application materials. The Chairman noted that the building containing the apartment is almost entirely within the front yard setback and is, therefore, not a conforming structure. The Chairman asked Ms. Pardee about the history of the apartment and she briefly reviewed the file, stating that the apartment appeared to have been put in the building around 1990 and that the new owners wish to legalize the apartment. After a discussion, the Commission decided that this it does not meet the requirements of Section 5.12. On the motion of Mr. Lecher and the second of Ms. Atamain, the Commission voted unanimously to deny the application. The Chairman suggested that the applicant could apply to the Zoning Board of Appeals for a variance.

4. Application #18-22Z – 39 Orchard Drive (Assessor’s Map #37 & Lot #40) Deborah and Peter Mygatt – Request for a Special Use Permit, in accordance with Sections 4.2.3 (b) and 5.1, to use an existing building to conduct church services. To receive; set public hearing date.

Ms. Mygatt explained the application to the Commission. She stated that she is a Pastor and she currently has a small congregation of about 10 members. The property that she and her husband own contains a small, historic theater building where she hold services. The Chairman stated that a Special Use Permit is required for this use and that a public hearing is required for Special Use consideration. On the motion of Ms. Atamian and the second of Mr. Ogonek, the Commission voted unanimously to accept the application and set a public hearing date of January 9, 2019.

5. Approve Meeting Dates for 2019
The Commission reviewed the list of proposed meeting dates for 2019. On the motion of Mr. Ogonek and the second of Ms. Atamian, the Commission voted unanimously to accept the meeting dates and file them with the Redding Town Clerk.

6. Discussion
There was no discussion under this agenda item.

7. Future Agenda Items
Public Hearing 18-22Z on January 9, 2019.

8. Communication
The Chairman brought up a recent approval of a solar array in Ridgefield where the approval is being challenged. He suggested the Commissioners think about the possible sizes of solar arrays.
He also noted that Ridgefield is moving forward with a fracking ban, as Redding has done.
He reported that there is no change regarding the Gilbert and Bennett property.

9. Adjournment
On the motion of Ms. Atamian, and the second of Mr. Lecher, the Commission voted unanimously to adjourn at 7:55 p.m.
