REDDING ZONING COMMISSION
REGULAR MEETING
WEDNESDAY, FEBRUARY 27, 2019
7:30PM TOWN HALL HEARING ROOM

Present: Gerry Casiello, Chairman; Matt Lecher, Vice Chairman; Amy Atamian, Secretary; Paul Scholl (Absent); Commissioner Ted Ogonek; Alternate Gary Miyashiro.
Also Present: Aimee Pardee, Zoning Officer; Applicants; Members of the Public.

Chair Casiello called the meeting to order at 7:30PM.

PUBLIC HEARING: Application #19-1Z – 65 Hopewell Woods Road (Assessor’s Map #9 & Lot #20) – Robert & Nicole A. Denkin – Request for a Special Use Permit for an accessory apartment in accordance with Section 5.12 of the Redding Zoning Regulations.

MOTION:
Mr. Ogonek made a motion to accept the call for Application #19-1z. Mr. Lecher seconded the motion. The vote was unanimous, and the motion carried.

Nicole Denkin, the applicant, addressed the Zoning Commission. She said that she has a mother in-law who has Alzheimer’s. The purpose of the accessory apartment is to house her mother-in-law.

Chair Casiello asked where the apartment would be located. Ms. Denkin said the apartment would be in her basement. No additional buildings are being constructed on the property.

Chair Casiello said the Planning commission approved the application for an accessory apartment.

Timothy Shea, Ms. Denkin’s neighbor, addressed the Zoning Commission about his concerns with the shared driveway. He said the access to the driveway and increased traffic were concerning for him.

Chair Casiello stated that it is the responsibility of homeowners to make sure their driveways are safe.

Chair Casiello stated that Ms. Denkin and the Shea’s need to have a conversation about these concerns outside of the meeting.

Chair Casiello stated that the Health Department has conducted a test confirming that there is space and soil adequate to install another septic feature.

Mr. Casiello read a letter written by the Shea’s asking the Zoning Commission to deny the application.

MOTION:
Mr. Ogonek made a motion to close the public hearing. Ms. Atamian seconded the motion. The vote was unanimous, and the motion carries.

Chair Casiello called the regular meeting to order at 7:52PM.

REGULAR MEETING:

  1. Approval of Minutes: Public Hearing and Regular Meeting Minutes of January 23, 2019.

MOTION:
Mr. Ogonek made a motion to approve the minutes from January 23, 2019. Ms. Atamian seconded the motion. There were four yes votes (Casiello, Lecher, Ogonek, and Atamian) and one abstention (Miyashiro). The motion carries.

  1. Application #19-1Z – 65 Hopewell Woods Road (Assessor’s Map #9 & Lot #20) – Robert & Nicole A. Denkin – Request for a Special Use Permit for an accessory apartment in accordance with Section 5.12 of the Redding Zoning Regulations.

Chair Casiello asked Ms. Pardee for her comments on the application. Ms. Pardee stated that the Building Official has not yet approved the accessory apartment.

Discussion followed concerning the legal responsibility of the town if something happened on the properties. The board discussed how the driveway is private property and is not the jurisdiction of the town.

MOTION:
Mr. Ogonek made a motion to approve Application #19-1Z with the condition that the Building department approves the apartment. Ms. Atamian seconded the motion. The vote was unanimous, and the motion carries.

Future Agenda Item: Application #18-22Z – 39 Orchard Drive (Assessor’s Map #37 & Lot #40) Deborah and Peter Mygatt – Request for a Special Use Permit, in accordance with Redding Regulations Sections 4.2.3 (b) and 5.1, to use an existing building to conduct church services. Received December 12, 2018: Public Hearing Opened January 9, 2019 and continued to January 23, 2019. Public Hearing will now be continued to the meeting of March 13, 2019.

Ms. Pardee suggested the Zoning Commission change the application name from 39 Orchard Drive to 39 Orchard and 67 Glen Hill Road. She said that the property owners are considering changing the property lines to meet regulations.

Mr. Lecher asked Ms. Pardee if the focus of this application will focus on 67 Glen Hill Road and not on 39 Orchard Drive. Ms. Pardee said this is not the intention of the name change.

Mr. Ogonek made a motion to adjourn the meeting. Ms. Atamian seconded the motion. The vote was unanimous, and the motion carried.
